These Terms and Conditions apply to all websites, mobile sites, course materials, programs and features (collectively, the "materials") owned and operated by Realty Publications, Inc. (RPI) doing business as first tuesday ("first tuesday").

By accessing this website, you are agreeing to these website Terms and Conditions of Use (the "terms"), all applicable laws and regulations, and agree to comply with any applicable local laws.

You further agree when you enroll in a course with first tuesday you will abide by all instructions and rules laid forth on the General Information page.

If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Privacy Policy

first tuesday has developed a Privacy Policy to help you understand how we collect, use, communicate and disclose and make use of personal information. By using our materials, you agree to our use of your information as set forth in the Privacy Policy.

3. Intellectual Property

Except where indicated, all books (both electronic and printed), quizzes, exams, answer keys, course materials, forms, marketing materials, graphics, advertisements, articles and videos are the intellectual property of first tuesday and protected by copyright laws.

4. Use License

Permission is granted to use the materials on first tuesday's website only for personal, non-commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

1. modify, copy or translate the materials;
2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
3. attempt to decompile or reverse engineer any software contained on first tuesday's website;
4. remove any copyright or other proprietary notations from the materials; or
5. transfer the materials to another person or "mirror" the materials on any other server.

Your violation of these restrictions automatically terminates this license. Further, the license may be terminated by first tuesday at any time. Upon the termination of this license, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

5. Shipping

Orders placed before 3:00 PM PST for overnight shipping (or overnight shipping with Saturday delivery) ship out the same day, and for orders placed on the weekend, the next business day.

All other orders ship out the business day after the order is placed. Standard shipping method is United States Postal Service (USPS) media mail. Standard shipping time is 5 to 7 business days, but shipping times vary. first tuesday is not liable for delays in delivery due to USPS holiday closures or out-of-state deliveries.

6. Lost materials

We gladly reship lost materials free of charge upon request during your 1-year enrollment, provided the applicable shipping time window has passed.

7. Refunds

first tuesday offers a 100% moneyback guarantee.

For all materials except the online video crash course and the state exam prep book, you must make the refund request during the 1-year enrollment period, and before any exams are taken. If you want to substitute courses (other than the online video crash course) during your 1-year enrollment period, a different course of your choice will be sent to you for a $17.50 substitution fee.

For the online video crash course and state exam prep book, your refund request must be made within 90 days of purchase.

8. Limitations

first tuesday is not liable for any damages (including damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on first tuesday's website, even if first tuesday has been notified orally or in writing of the possibility of such damage.

9. Revisions and Errata

While first tuesday makes every effort to provide accurate and reliable information and materials, the materials appearing on first tuesday's website may include technical, typographical, or photographic errors. first tuesday does not warrant that any of the materials on its website are complete or suitable for every purpose. first tuesday may make changes to the materials contained on its website at any time without notice.

10. Links

first tuesday has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by first tuesday of the site. Use of any such linked website is at the user's own risk.

11. Site Terms of Use Modifications

first tuesday may revise these terms of use for its website at any time without notice. By using this website you are agreeing to the then current version of these terms.

12. Governing Law

Any claim relating to first tuesday's website shall be governed by the laws of the State of California.
